State of the Nation ...

Republicans on the House Judiciary Committee killed an amendment by Rep. Mike Quigley (D-IL) that would have closed the so-called “terror gap” — preventing firearm sales to suspected terrorists. GOP members want to protect the right of people on the FBI’s terrorist watch list to purchase firearms, arguing that preventing sales would “steal the Second Amendment rights of those placed on the list by mistake.”
All Republicans as far as I can tell, and way too many Democrats, appear to have no real problem with the no-fly list.

No problem that is until it's a question of prohibiting someone on the list from buying guns. To a Republican, and apparently to some Democrats, that is just absurd. Prohibit a terrorist from obtaining firearms? That just won't do! It's their Constitutional Right, after all to have weapons. Like many people on this freedom-protecting list, they might not be terrorists anyway, as there's no control of who gets on the list nor any mechanism to get the innocent off the list. In general, the no-fly list appears to be a generalized US Government I-don't-like-you list. The Republicans, of course, highly approve of this means of government control and punishment. Just think of the fun they had putting Senator Kennedy on the list.

Am I giving Republicans too much credit when I assume that they don't think most of the people on the list are terrorists? And that's the reason they don't want the ability to purchase guns to be tied to such an embarrassing fiasco as the US No Fly list?

Until further proof of their perfidy I will assume that the inaccuracy of the list is the reason they don't wish to tie gun purchasing ability to the list and not that they actually want terrorists to have guns.

Definitely, let us keep the sick from benefits because the US Government has decided to target them. Who cares what beneficial service they may have provided in the past that earned them such a benefit. They are now on THE list. That's all that matters. No health care but they can still get a gun.

About the state of our nation: What can I say that I haven't said before? Just notice that all the wrangling is about what membership on this list will effect. Nothing that I've seen addresses the use and abuse of this list. Nothing that I've seen attempts to put some control on how someone gets added to this list. Nothing that I've seen provides a mechanism to get off the list. The draconian nature of this list appears to concern no one in the political sphere nor the justice sphere.

What else can I say about the state of our nation that this example doesn't elucidate?

Communism, fascism and democracy ...

Communism and fascism seem to me to have the same ultimate result: making sure workers are completely under the control of management. It seems to make little difference whether management is the government, the party or private industry. Effective slavery is the result.

The US has always had it's proponents for the complete control of workers. But with the T-Bags it's coming to the fore with draconian, or Dicksonian, ferver.

I beg to differ. Treasury, as does Obama himself, believe they work for the banksters and other powerful industries.

Elected officials still have to play the election game but money and the corporate controlled media are able to effect sufficient numbers of election campaigns. And when they fail, there's always the Supreme Court who can choose to appoint an embarrassment like Bush to reside in the WH.

Obama, it appears, gave acceptable assurances to the banksters (and others) before he was elected. To get the votes Obama aimed his promises at the fair minded, the liberals, the progressives, the unions, those interested in a responsive and fair government, those who were against these unending wars.

What did Obama do once he was elected? He appointed people who failed to recognize, or actually contributed to, the financial problems of the country. He continued most of Bush's disastrous war and torture policies. He took care to insult most of those who voted for him. His actions and policies appear taken in response to the desires the Robber Barons and the actions of the Crazies.

Everyone has blind spots ...

... but most of us don't have to defend them on video. Howard Dean seems to me to blindly miss the point while thinking Glenn Greenwald (whose position I mostly agree with) is the one who is missing the point:

I think I do see into what terms (local zoning) Dean is attempting to constrain the issue. I just don't think it can be constrained. The pressure is on for one group to give up, or have taken away, their --I believe already approved--- plans because a bunch of mostly non-affected US citizens see it as an issue they can make waves with.

We get -- from the current Government -- presidential assassination programs, detention with no charges, senseless demands for further reductions of core rights when arrested, ongoing secret prisons filled with abuse, military commissions, warrantless surveillance of emails, and presidential secrecy claims to block courts from reviewing claims of government crimes. The Democratic-led Congress takes still new steps to block the closing of Guantanamo. Democratic leaders push for biometric, national ID cards. The most minimal surveillance safeguards are ignored. Even the miniscule limits on eavesdropping powers are transgressed. And from just this week: "Millions of Americans arrested for but not convicted of crimes will likely have their DNA forcibly extracted and added to a national database, according to a bill approved by the U.S. House of Representatives on Tuesday" ...

On the politics, one hates to jump to conclusions but it is very curious that in virtually every single issue area, the administration goes out of its way to reject the people and items that are at the top of the liberal agenda. It's hard to believe that it's an accident.

Obama may sound more reasonable than Bush the Lesser, but ...

... Obama's unconstitutional imprisonment and kidnapping policies for anyone his administration doesn't like is the same. Maybe, perhaps they aren't torturing them. But secrecy and injustice lead to lies, so who knows. And any nation that regularly tortures its own citizens with Tasers is hardly to be believed on this issue.

Does that remotely sound like a "justice system"? If you're accused of being a Terrorist, there's not one set procedure used to determine your guilt; instead, the Government has a roving bazaar of various processes which it, in its sole discretion, picks for you based on ensuring that it will win. Even worse, Holder repeatedly assured Senators that the administration would continue to imprison 9/11 defendants even in the very unlikely case that they were acquitted, citing what they previously suggested was their Orwellian authority of so-called "post-acquittal detention powers." Is there any better definition of a "show trial" than one in which the defendant has no chance of ever being released even if acquitted, because the Government will simply thereafter assert the power to hold him indefinitely without charges?

The administration should have the courage of its convictions and defend jury trials as a linchpin of American justice, which would entail giving them to all Terrorism suspects not captured on any battlefield. But by refusing to do so -- by exhibiting the very cowardice of which Holder accused Republicans, i.e. denying Terrorism suspects a trial -- the administration has no cogent argument to make in its own defense. It's just another case of the administration wanting to bask in the rhetorical glory of "the rule of law" while simultaneously trampling on it for petty political convenience.
That is IF this administration has convictions. This Democratic Administration has become Republican Lite. Now that's really scary ...

The Republicans at least have a goal, a creed. Perpetual war, perpetual dominance of the world, ensuring the 'haves' have all and the 'have-nots' are effectually slaves. It's very direct, very simple minded. What you say today only applies to today. Justice is a word like any other.

Republican Lite, one the other hand, is an attempt to appease. A cowardly approach with no principals behind it that can be defended.

Is Obama trying to be Solomon? Now that the Thugs have demanded that he split the baby, and he's actually tried, what is he going to do next? I think the lesson of Solomon and the baby is one that the Thugs understand and Obama does not. Solomon wished to identify the real mother. Obama's actions are more like negotiating with the fake mother and pushing the real mother out of the way.

Do you think you have rights protected by the US Constitution? ...

Think again.
Yesterday, the Second Circuit -- by a vote of 7-4 -- agreed with the government and dismissed Arar's case in its entirety. It held that even if the government violated Arar's Constitutional rights as well as statutes banning participation in torture, he still has no right to sue for what was done to him.
If the person elected as President under the US Constitution says he doesn't want your 'rights' protected because he's got a secret, seven judges agree that though you may have rights they will not deign to inquire into them because the President claims he has a secret. The President does not want you bothering him any further with all that US Constitution crap. The only part of the US Constitution that matters is any part that favors him.

After all it's only a piece of paper, why not cut and paste as his little secret heart desires ...

I want to add one principal point to all of this. This is precisely how the character of a country becomes fundamentally degraded when it becomes a state in permanent war. So continuous are the inhumane and brutal acts of government leaders that the citizens completely lose the capacity for moral outrage and horror. The permanent claims of existential threats from an endless array of enemies means that secrecy is paramount, accountability is deemed a luxury, and National Security trumps every other consideration -- even including basic liberties and the rule of law. Worst of all, the President takes on the attributes of a protector-deity who can and must never be questioned lest we prevent him from keeping us safe.

This is exactly why I find so objectionable and dangerous the ongoing embrace by the Obama administration of these same secrecy and immunity weapons. Obama had nothing to do with the Arar case -- all the conduct, and even the legal briefing, occurred before he was President -- but he has taken numerous steps to further institutionalize the core injustice ...
Obama has taken up the cause of that Monster, Bush the Inferior (not to mention that other Monster, Cheney the Deranged). Sorry, Dems, but that makes Obama a monster. He can parade his cute family all he wants. They do not prevent his monsterhood. Obama is accountable for his own actions and he has chosen to follow Bush's path. In Heaven's Name, WHY?

The future looks ....?

As Kaptur said, given the size and scope of "the largest transfer of wealth from the American people to the biggest banks in this country," one would expect there to be massive public interest in what happened and why, and, more so, whether any of this is being fixed (it plainly isn't). One would particularly expect the Democratic Party -- which has long branded itself as being the populist party against Wall Street -- would be leading that charge, for political benefit if not for substantive reasons. But that's clearly not happening, and the primary reason why is because both political parties, as institutions, are dependent on and thus controlled by the very industry that is at the heart of it.

Among the two parties, there's no outlet for the populist anger that Kaptur understands and is voicing because each party is eager to serve the interests of those who fund them. And that's why Democrats have largely ceded the populist anger over Wall Street to GOP operatives who are exploiting the "tea party" movement as the only real organized citizen activism over these issues. ...

This is hardly unique to the banking industry. This is how the political system works generally. Earnest, substantive debates over this or that policy are so often purely illusory, as the only factor that really drives that outcomes is the question of who owns and thus controls the political system. That central fact subsumes just about everything else.
I keep hoping that I don't live to see how far the US will go along this road ... which means that I hope that we can restore some for-the-people, by-the-people and of-the-people to our government and if that does not happen that at the very least the worsening does not completely stop my enjoyment of life ... as in reality I'm in no hurry to leave it.

Today's quote ...

Over time Americans will learn that in order to maintain their liberty, they must instantly comply with everything those in authority tell them to do. The police will follow the edicts of their civilian leaders, who sanction torture on many different levels "to keep the people safe." The population will learn eventually that they will automatically be shocked with electricity if they fail to comply and over time they will be conditioned to fall in line regardless of their constitutional right to speak or resist unwarranted intrusion.
